1. Introduction and Acceptance

These Terms and Conditions (“Terms”) govern your access to and use of the ContentCatch platform, including:

By creating an account, clicking “Sign up”, or using the Service, you agree to these Terms. If you do not agree, you must not use the Service.

If you use the Service on behalf of an organisation, you confirm you have authority to bind that organisation, and “you” refers to both you and that organisation.

2. Definitions

  • Account — your ContentCatch user account
  • User — any individual or business using the Service
  • Client — a third party submitting data via a User’s form
  • Form — a data collection form created in the Service
  • Submission — a Client response, including files
  • Content — all data, text, files, and materials in the Service
  • Plan — your subscription tier governing available features and limits

3. Eligibility

You must be at least 18 years old to use the Service.

ContentCatch is intended for business and professional use only.

4. Accounts

4.1 Registration

You must provide accurate and complete information and keep it updated.

4.2 Account Security

You are responsible for your account and must:

5. The Service

5.1 Description

ContentCatch allows you to:

  • Build and publish forms
  • Collect and manage submissions
  • Store files
  • Use AI-assisted tools (on eligible plans)
  • Communicate with clients

5.2 Plan Limits and Features

Your use of the Service is subject to the limits, features, and usage allowances of your selected Plan.

We may update plan features, limits, and pricing from time to time with reasonable notice.

5.3 Availability

We aim for reliability but do not guarantee uninterrupted service.

5.4 Changes to the Service

We may update or modify features. Material changes will be notified in advance.

6. Subscriptions and Billing

6.1 Paid Plans

Paid plans are billed on a recurring basis (monthly or annually), as selected at checkout. Current pricing is available at:

6.2 Payment

Payments are processed by Stripe, Inc.. You authorise recurring charges.

6.3 Free Trial

Trials convert to paid plans unless cancelled before the end.

6.4 Renewals and Cancellations

  • Subscriptions auto-renew
  • Cancel via Settings → Billing
  • No partial refunds unless required by law

6.5 Downgrades

If you downgrade your Plan:

  • Changes take effect at the end of the billing period
  • Features and limits will adjust בהתאם to the selected plan
  • You are responsible for managing your data within the new limits

6.6 Refunds

We offer a 14-day money-back guarantee for first-time subscriptions.

6.7 Taxes

You are responsible for applicable taxes unless we are required to collect them.

6.8 Failed Payments

We may retry payments and suspend accounts if unpaid.

7. Acceptable Use

7.1 Permitted Use

Use the Service only for lawful business purposes.

7.2 Prohibited Use

You must not:

  • Collect data unlawfully
  • Target minors without consent
  • Upload illegal or harmful content
  • Conduct fraud, spam, or phishing
  • Interfere with the Service
  • Access other accounts without permission
  • Reverse-engineer or scrape the Service
  • Build competing products

We may investigate and take action.

8. Your Content and Data

8.1 Ownership

You retain ownership of your Content.

8.2 Licence

You grant us a limited licence to process your Content to provide the Service.

8.3 Responsibility

You are responsible for:

  • Legal compliance
  • Data collection rights
  • Client consent and privacy notices

8.4 Data Processing

You are the controller, and ContentCatch acts as processor for Client data.

8.5 No Endorsement

We do not review or guarantee user content.

9. AI Features

9.1 AI Assistant

AI features use OpenAI. Client input may be processed externally.

9.2 No Guarantees

AI output may be inaccurate. Use at your own risk.

9.3 Credits

AI usage is subject to limits defined by your Plan (see pricing page).

10. Intellectual Property

10.1 Platform Rights

The Service and all related IP belong to ContentCatch.

10.2 Feedback

You grant us rights to use any feedback you provide.

11. Third-Party Services

We rely on third-party providers (payments, hosting, AI, etc.).
Their terms and policies apply.

We are not responsible for third-party services.

12. Confidentiality

Both parties agree to keep confidential information private unless required by law.

13. Disclaimer of Warranties

The Service is provided “as is” and “as available”.

We do not guarantee:

  • Continuous availability
  • Error-free operation
  • Security or reliability
  • Suitability for your needs

14. Limitation of Liability

14.1 Indirect Loss

We are not liable for indirect or consequential damages.

14.2 Liability Cap

Our total liability is limited to the greater of:

  • Fees paid in the last 12 months
  • £100

14.3 Exceptions

Nothing excludes liability for:

  • Death or personal injury
  • Fraud
  • Legal obligations that cannot be excluded

15. Indemnification

You agree to indemnify ContentCatch against claims arising from:

  • Your misuse of the Service
  • Your Content
  • Legal or regulatory violations

16. Term and Termination

16.1 Term

These Terms apply while your account is active.

16.2 Termination by You

You can close your account at any time.

16.3 Termination by Us

We may suspend or terminate accounts for:

  • Breach of Terms
  • Non-payment
  • Legal or risk reasons

16.4 Effect

Access ends immediately. Data is retained for 30 days before deletion.

17. Force Majeure

Neither party is liable for events beyond reasonable control.

18. Governing Law

These Terms are governed by the laws of England and Wales.

Disputes are subject to those courts.

19. General

19.1 Entire Agreement

These Terms + Privacy Policy + DPA form the full agreement.

19.2 Severability

Invalid provisions do not affect the rest.

19.3 No Waiver

Failure to enforce rights does not waive them.

19.4 Assignment

You may not transfer your rights. We may.

We may update these Terms with notice. Continued use = acceptance.
